What Can You Buy With EBT? 2026 Rules and State Bans

Rules verified against USDA guidance and current state waiver status. Reviewed October 2026.

What you can buy with EBT used to have one answer for the whole country. In 2026 it has two layers: the federal rules that still govern everywhere, and a new patchwork of state restrictions on soda and candy that took effect in some states, got blocked by a federal court in others, and is still moving through appeals. This page covers both layers, what never changed, and how to know your own state’s answer.

The Federal Baseline: What SNAP Buys Everywhere

SNAP covers any food or food product for human consumption, plus seeds and plants that grow food. That includes:

  • Fruits, vegetables, meat, poultry, fish, dairy, breads, and cereals.
  • Snack foods and non alcoholic beverages, subject to the new state layer below.
  • Cold prepared foods like deli salads and cold sandwiches sold to eat at home.
  • Seeds and food producing plants, one of the program’s best kept secrets: a few dollars of tomato plants returns a season of produce.

What SNAP Never Buys, Anywhere

  • Alcohol and tobacco, in every state, always.
  • Hot foods and foods sold to eat in the store, like a rotisserie chicken hot from the warmer, with narrow disaster exceptions.
  • Vitamins, supplements, and medicines, which is why a supplement’s label matters: an item with a Supplement Facts panel is not SNAP eligible, one with a Nutrition Facts panel is food.
  • Pet food, soap, paper goods, cleaning supplies, and other household non food.
  • Live animals, with limited exceptions like shellfish.

The 2026 Layer: State Soda and Candy Restrictions

Starting January 2026, states began enforcing federally approved waivers that remove certain items, mostly soda, candy, and in some states energy drinks or broader junk food categories, from SNAP eligibility inside their borders. Roughly ten states currently enforce restrictions, including Texas, Florida, Indiana, Utah, Oklahoma, Arkansas, Louisiana, Idaho, North Dakota, and South Carolina, with several more approved to start in 2027 and beyond, and each state defines its restricted list differently.

Then the courts entered: in June 2026 a federal judge ruled the USDA lacked authority to approve five of the waivers, so the restrictions in Colorado, Iowa, Nebraska, Tennessee, and West Virginia are blocked, and recipients there can currently buy soda and candy again while the government’s appeal proceeds. The other states’ restrictions were not part of that case and remain in force.

The practical rule in a moving landscape: your state’s SNAP agency mails and posts notices before restrictions start, the register simply declines ineligible items rather than fining anyone, and this page’s account reflects the situation as of its review date. When in doubt, the notice from your own state beats any national article, this one included.

Can I buy soda with EBT?

In most states yes, in roughly ten states currently no, and in five states the ban was blocked by a court. Your state’s SNAP notices give the answer that counts at your register.

Can I buy a rotisserie chicken with EBT?

Not while it is hot. The same chicken sold cold from the refrigerated case is eligible, which is the strangest rule in the program and entirely real.

Can I buy energy drinks with EBT?

Depends on the label and the state: those with a Nutrition Facts label are federally eligible food, those labeled as supplements are not, and a few states now restrict them by waiver regardless.

Does EBT work for grocery delivery?

Yes, at participating retailers including Amazon, Walmart, and Aldi in most states, paying for eligible food but not delivery fees or tips, which need another payment method.

Can I buy seeds and plants with EBT?

Yes, any seeds or plants that produce food for your household, at retailers that stock them. It is among the highest return purchases the program allows.
