Process verified against VA claims guidance. Reviewed October 2026.
Filing a VA disability claim is free, doable online in an afternoon, and governed by a handful of rules that decide months of back pay: the intent to file that locks your date before you are ready, the three elements every claim must show, the C&P exam where claims are won and lost, and the free accredited help that outperforms every paid consultant. This page walks the whole path.
Before Anything: Lock the Date
An intent to file, submitted online, by phone at 800-827-1000, or on a one page form, preserves your effective date for a full year while you gather evidence. Benefits are eventually paid back to that date, so a veteran who files an intent in January and completes the claim in October is paid as if approved from January. It costs nothing, commits you to nothing, and skipping it is the most expensive common mistake in the system.
The Three Things Every Claim Must Show
Not sure if you qualify for benefits? Check in under 2 minutes — it's free, private, and shows estimated amounts.
- A current diagnosed condition, documented by medical records, VA or private.
- An in service event, injury, illness, or exposure, shown by service records, or covered by presumptions: the PACT Act made many burn pit, Agent Orange, and radiation exposures presumptive, meaning the service connection is assumed for qualifying service.
- A nexus connecting the two, the medical link between service and today’s condition. For presumptive conditions the nexus is automatic; for everything else, a medical opinion connecting them is the heart of the claim, and secondary conditions, ones caused by an already service connected condition, use the same logic.
Filing and the C&P Exam
File online at VA.gov, by mail on form 21-526EZ, or through an accredited Veterans Service Officer, and the fully developed claim route, submitting all your evidence up front, is the fastest track the VA offers. Then comes the Compensation and Pension exam, where an examiner evaluates the condition for rating purposes, and where honest, worst day specificity matters: describing your condition as it is on bad days, in concrete functional terms, is not exaggeration, it is the data the rating formula runs on. Missing a scheduled C&P exam, meanwhile, can sink an otherwise strong claim, so it is the one appointment of the process to protect absolutely.

Denied, or rated lower than the evidence supports, the decision review system offers three distinct lanes with a one year clock, walked in our appeals guide. Frequently Asked Questions
How long does a VA disability claim take?
Several months is typical, with fully developed claims moving fastest, sometimes within weeks. The intent to file makes the wait cost nothing, since pay reaches back to the locked date.
Does filing a VA claim cost anything?
Nothing, ever, and accredited VSO help is free too. Anyone charging to file an initial claim, or a percentage of your back pay to prepare one, is exactly who the VA’s warnings are about.
What conditions are presumptive?
The PACT Act expanded the list substantially for burn pit and toxic exposures, adding to the longstanding Agent Orange and radiation presumptions. If you served in a covered location and period, the service connection element is assumed, which turns a hard claim into a straightforward one.
What happens at the C&P exam?
An examiner assesses your condition against the rating criteria, through questions, measurements, and record review. Describe your worst days concretely, bring nothing but honesty and specifics, and never skip it.
Can I file for conditions that got worse, or new ones, later?
Yes, increase claims and new claims are routine, secondary conditions can be claimed as they emerge, and each follows the same three element logic. A denied condition can also be reopened with new evidence at any time.
